Normally conflicts that cannot be solved in in-house negotiations are fought out in court. In this case, claims derived from the past are supposed to be adjudicated in a positive manner by a judge. Ruled by emotions, the primary aim then is to "obtain justice."
When court litigation begins, the parties abandon control over the course and outcome of the process: Information is requested and provided at the discretion of the judge and the litigation parties are in no way involved in arriving at the judgment.
One of the two will leave the courtroom as a loser. This defeat puts the party in question in a position from which it cannot derive any benefit: A new conflict is preprogrammed.
What makes more sense than a claim-oriented setoff against the past is a future-oriented treatment of the conflict.
